1. Privacy Policy for Job Applicants

This Privacy Policy for PEAK Wind Group’s (‘PEAK Wind’) Job Applicants will explain how our organization uses the personal data we collect from you when you apply for job opportunities in PEAK Wind. PEAK Wind will comply with EU’s General Data Protection Regulation (‘GDPR’) throughout the process.

1.1 What personal data do we collect?

PEAK Wind processes data about you when this is necessary and in accordance with the applicable legislation. We collect the following personal data from you, so we can evaluate you as a potential match for PEAK Wind during the recruitment process:

  • Name, address, phone number, email address, LinkedIn profile, CV, profile picture, letter of motivation, letter of recommendation, educational documents, transcripts, references from former employers, date of birth, nationality, residence- and work permit
  • We do not process sensitive personal data, i.e., the special category of personal data like health information

1.2 How do we collect your personal data?

You decide what personal data to provide PEAK Wind. We collect and process personal data about you, from you, when you:

  • Apply for a job via our recruitment system (we use ‘Emply’ as our platform provider)
  • Write directly to us via our email, including recruitment@peak-wind.com

PEAK Wind may also process your data from LinkedIn in our recruitment system, Emply. When this is the case, we only store and process:

  • The link to your LinkedIn profile
  • Your name which you have made available on LinkedIn
  • Your email address if this has been made available on LinkedIn

1.3 How will we use your data?

PEAK Wind collects and processes your personal data so that we can:

  • Process your job application and recruit the relevant people
  • Create and maintain a talent pool of relevant candidates for potential positions at PEAK Wind

We may share your personal data with our colleagues who are involved in the recruitment process, and third parties who assist us, e.g., external recruitment companies, who must comply with GDPR as well.

1.4 How do we store your personal data?

PEAK Wind securely stores your personal data in our recruitment system, Emply.

1.5 On what legal bases do we process your personal data?

We only process your personal data when we have a legal basis to do so in accordance with the GDPR.

Depending on the specific circumstances, the processing of personal data is done on the following legal basis:

  • If we have asked for your consent for the processing of specific personal data, the legal basis for the processing of such personal data is your consent. The consent can always be withdrawn by contacting us via the contact details provided at the end of this Privacy Policy, and, if the consent is withdrawn, the personal data processed on the basis of the consent is deleted, unless it can or must be processed, for example, in order to comply with legal obligations. If you chose to withdraw your consent, this may also mean that we cannot continue the recruitment process with you.
  • The processing is necessary for compliance with local legislation and legal requirements, including any specific rules on the processing of personal data in the employment context.
  • The processing is necessary for the purposes of the legitimate interests where such interests are not overridden by the interests or fundamental rights and freedoms of the data subject (you) which require protection of personal data.

1.6 When will your personal data be erased?

We keep your application and any other personal data you have provided to us until the recruitment process has been completed and for a period thereafter for as long as we consider your application relevant to us, but under no circumstances for longer than 6 months, or when there is no longer a legal requirement to process it. We may retain personal data if we have an obligation to do so from applicable law, as long as it operates within GDPR. If we would like to keep your personal data for another 6 months, we will reach out to you to get your renewed consent.

If you become a team member of PEAK Wind, your personal data will be transferred to our internal HR Management system, to meet applicable laws, e.g., employment laws or accounting and booking laws.

2. What are your Data Protection Rights?

PEAK Wind would like to make sure you are fully aware of all your Data Protection Rights, which are:

  • The right to access – You have the right to request PEAK Wind for copies of your personal data. We may charge you a small fee for this service.
  • The right to rectification – You have the right to request that PEAK Wind correct any information you believe is inaccurate. You also have the right to request PEAK Wind to complete the information you believe is incomplete.
  • The right to erasure – You have the right to request that PEAK wind erase your personal data, under certain conditions.
  • The right to restrict processing – You have the right to request that PEAK wind restrict the processing of your personal data, under certain conditions.
  • The right to be informed – You have the right to be informed about how your data is being used and with whom it is being shared.
  • The right to data portability – You have the right to request that PEAK Wind transfer the data that we have collected about you to another organization, or directly to you, under certain conditions. We may charge you a small fee for this service.
  • The right to object to processing – You have the right to object to PEAK Wind’s processing of your personal data, under certain conditions.
  • The right to individual decision-making – You are protected against any automated data processing that might involve profiling you based on personally identifiable information.

3. Changes to our Privacy Policy for Job Applicants

PEAK Wind keeps its Privacy Policy under regular review and places any updates in here. This Privacy Policy is version 1.2 – last updated on December 18th, 2023.
