This Privacy Policy for Participants of PEAK Wind Academy, part of PEAK Wind Group (‘PEAK Wind’), explains how our organisation collects and processes your Personal Data when signing up and attending courses provided by PEAK Wind Academy.

We refer to our Privacy Policy for Website Visitors for any information on how PEAK Wind Group collects and processes your Personal Data through your use of our website peak-wind.com.

Policy for Data Processing

What data do we collect?

Personal Data describes any information that relates to an identified or identifiable living individual.

From the data you share when signing up for and/or attending a PEAK Wind Academy course we may process the following categories of Personal Data about you:

  • Personal Data (non-images) which includes data relating to any purchases and/or attendances of courses including but not limited to your first name, family name, preferred gender pronounce, job title, email address, mobile number incl. country code, country of residence, special dietary requirements, company name, company address, company VAT no., company PO no..
  • Personal Data (images) which includes but is not limited to data relating to your image in photos or video recordings.
  • Communication Data which includes but is not limited to any communication that you send to us through our website, email, text, social media messaging, social media posting, online chats or any other form of communication.

How do we collect your personal data?

Collection of Personal & Communication Data

You directly provide PEAK Wind with most of the data we collect. We collect data and process data in these situations:

  • Personal Data (non-images) & Communication Data when you communicate with us regarding a PEAK Wind Academy course (via online forms, email, or phone), such as for sign-up, feedback, or other communications.
  • Personal Data (images) when you attend a course, where we may take photos or do video recordings of the session.

Collection of Sensitive Data

PEAK Wind does not collect any Sensitive Data about you. Under the GDPR Sensitive Data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data.

On what legal basis do we process your personal data?

Overall, we base our collection and processing of your Personal Data on the performance of a contract and/or your active consent when signing up for a PEAK Wind Academy course. By signing up for any PEAK Wind Academy activities, you must read, understand, and give your active consent to this Privacy Policy.

If you don’t want to do that, we won’t be able to offer you a spot on a PEAK Wind Academy course, as we need the above-mentioned data to handle administrative task related to sign-up and payment procedures.

How will we use your data?

PEAK Wind process the following types of data for the following purposes:

  • Personal Data (non-images): We will use this data to provide you with the PEAK Wind Academy courses and related course content you have purchased, and to keep records of the related transactions for internal purposes, related to proper invoicing, course improvement, etc. Our lawful ground for this processing is the performance of a contract and/or your active consent between you and us when signing up for a PEAK Wind Academy course.
  • Personal Data (images): We may take photos or do video recordings of courses that could include your image. Our lawful ground for collecting these data (images) is your active consent when signing up for a PEAK Wind Academy course. Once we have collected these data (images) we will review the photos and video recordings that may include your image to ensure that you, the Data Subject, is presented in a fair and professional manner. Images that do not meet these requirements will be deleted. The remaining photos or video recordings including your image, may be used for marketing purposes. Before we process your image for any specific marketing purpose, we will ask for your permission in writing to use the relevant images. If you decline, we will erase your image in the photos and video recordings. Group photos are excepted from this, we will instead inform you verbally before we take the photo, and you will have the option to step out before the photo is taken.
  • Communication Data: We process this data with the purpose of communicating with you, for record keeping, product improvement, and for the establishment, pursuance, or defence of legal claims. Our lawful ground for this processing is our legitimate interests which in this case are to reply to communications between you and PEAK Wind, to keep records and to establish, pursue or defend legal claims.

How will we store your personal data?

We will store your Personal Data in the following confidential systems:

  • Personal Data (non-images) will be stored in PEAK Wind’s internal Microsoft 365 SharePoint and Outlook systems. Only people with a legitimate reason, will have access to these. Personal Data, needed for the payment transactions (e.g. your first name, family name, company name, company address, company VAT no., company PO no.) will be registered and stored via our finance system: e-conomic. Only people with a legitimate reason, will have access to these.
  • Personal Data (images) will be stored in PEAK Wind’s internal Microsoft 365 SharePoint and Outlook systems. Only people with a legitimate reason, will have access to these.
  • Communication Data will be stored in will be stored in PEAK Wind’s internal Microsoft 365 SharePoint and Outlook systems. Only people with a legitimate reason, will have access to these. Furthermore, Communication Data may also be stored in social media platforms (e.g. in LinkedIn), if you communicate with us there.

When will your personal data be erased?

PEAK Wind will erase your Personal Data once there is no longer a legal basis to process these. Due to our Legal Requirement, this could mean PEAK Wind may store your Personal Data for up to six (6) years after attending any PEAK Wind Academy activity/course. According to the Danish Accounting Act, PEAK Wind must store the accounting material in a secure manner for five (5) years from the end of the financial year to which the material relates.

Transfers of Personal Data to Third Party

Upon your consent, PEAK Wind will share your data with the following third-party providers so that they can deliver relevant products and services, that we need to deliver any PEAK Wind Academy activities. We have appropriate Data Processing Agreements in place with each of them to ensure that your Personal Data are handled safely:

  • Visma e-conomic A/S (VAT: DK-29403473) – to handle payment transactions. Read more here.
  • Microsoft Ireland Operations, Ltd. (Microsoft 365) – to handle all the administrative task (including, but not limited to; sign-up, communication, images) related to PEAK Wind Academy: Read more here.

 

When PEAK Wind processes your order, we may send your data to, and also use the resulting information from, credit reference agencies to prevent fraudulent purchases.

What are your data protection rights?

PEAK Wind would like to make sure you are fully aware of all your data protection rights. Every user is entitled to the following:

  • The right to access: You have the right to request PEAK Wind for copies of your Personal Data. We may charge you a small fee for this service.
  • The right to rectification: You have the right to request that PEAK Wind correct any information you believe is inaccurate. You also have the right to request PEAK Wind to complete the information you believe is incomplete.
  • The right to erasure: You have the right to request that PEAK Wind erase your Personal Data, under certain conditions.
  • The right to restrict processing: You have the right to request that PEAK Wind restrict the processing of your Personal Data, under certain conditions.
  • The right to be informed: You have the right to be informed about how your data is being used and with whom it is being shared.
  • The right to data portability: You have the right to request that PEAK Wind transfer the data that we have collected about you to another organization, or directly to you, under certain conditions. We may charge you a small fee for this service.
  • The right to object to processing: You have the right to object to PEAK Wind’s processing of your Personal Data, under certain conditions.
  • The right to individual decision-making: You are protected against any automated data-processing that might involve profiling you based on personally identifiable information.

PEAK Wind keeps this privacy policy under regular review and places any updates on this web page. This Privacy Policy is version 1 – last updated on 13th of May, 2024.
